The first part of my post was annoyance at how they have dealt with this scenario and that at £1k a month the house should be and continue to stay in good condition. The second part was asking whether we had a leg to stand on due to having to pay full rent on a house that is not in complete working order. I get the rules and will abide by them but it doesnt stop us being angry for paying for what we are not getting. Of course they are getting rid of us..tbh we will have the last laugh as i guaruntee it will sit for another few months and they will lose more money..more fool them not very sensible landlords imo but hey thier house. Well it's been a week..still no house but i'm hoping we have one sorted just haven't had a yes yet.
We had an email from the agency basically saying none of the jobs we requested to be done are going to be done and that the shower was never right to begin with etc..basically they had no intentions all along and have just been wasting our time which got our backs up even more.
The next thing we have to deal with is this house. When we moved in the house was never cleaned. We said if we could have the keys a couple of days earlier we would do it ourselves. It is a big house and its just taken ages to do the kitchen cupboards as there are so many..daren't even think about the rest of the house! SO where do we stand with cleaning it when we leave. We are by no way slobs and the house looks fine and we will do fridge, oven etc but do we need to go over with a fine tooth comb touching up every single mark as such? We are tbh very tempted to now risk some of our deposit and tell them to gte stuffed after the email?

You will have nothing to fear if you return the property in exactly the same condition at the end of your tenancy as it was at the beginning as long as you can prove it. If you can prove it I would consider not cleaning the place or cutting the lawn. Eff 'em!
Everything hangs on whether there was a dual-signed inventory or other documentary evidence at the start of your tenancy. Never underestimate the cynicism or ruthlessness of lousy landlords or their agents.0 -
There is an inventory pages of it! things like the usual decor in each room etc, there are the bads bit too and the photos of scratches etc other than that i guess we leave it as the inventory states. Garden photos were obviously done before the house was let as didnt look like the pics! we ammended some at the time too. Guess we are cross as once again expected this to be a long term house so didnt worry too much at the time.

You need to return the property in the same condition as when you began the tenancy, less fair wear and tear. If your deposit is protected you can dispute with the scheme any proposed deductions you don't agree with. Then it would be the Landlord's responsibility to prove the condition of the property at the beginning, show damage and evidence the cost to them.
Don't forget you still need to give notice if you want to move out.Don't listen to me, I'm no expert!0 -
Ok we had notice given until the 15th of June. We got another house sorted and gave our notice and have paid for this house until the 18th of May. We have just recieved our current lettings agent responce with checkout details ect and it says we have to pay our last months rent due? I thought and hope we are paid up but do we have to pay another month? Really hating this company as there are so many excess charges on it for bits just to add to the mess were in grr.

Earlier posts ask for your dates and G-M's post explains about what a tenant should do if leaving at the end of the fixed term or during a periodic tenancy which I think you said you are on.
If you want your notice (and the LL's notice) checked then post the start and end dates of your latest fixed term, the date the notices were served and what they said about leaving dates. I would not recommend relying on the agent telling you owe more without checking the dates out but if you give notice during a periodic tenancy it should be to the end of a period. That's why you have been asked for the end date of the last fixed term as the period will start the following day.
So if the last day of the fixed term was say February 15th, then the periodic tenancy will have started on February 16th, your rental periods will be from the 16th to the 15th and you would need to give at least a months notice ending on the 15th. Or a believe a tenant's notice could also be to the first day of a period so the 16th might be OK as well but would need checking. Either way the 18th would not do in this case but it depends on the date your fixed term ended!0 -

1. What were the start and finish dates of the fixed term part of your tenancy?
2. What date did you give your notice to the LL?0
