Ebay Item Incomplete - What to do?

I don't know what to do about this. I bought a basic Kindle from a private seller who had upgraded to the newer version. It wasn't cheap (for me), but still cheaper than a new one, so I happily waited for my item to arrive. And waited...
And waited...
Finally, it arrived 11 days after I paid (I know, I know, Easter hols and all that, but really).
And the USB lead, which was advertised as included wasn't in the packet
Effectively the Kindle is useless to me as I can't use it until it is complete.
I have contacted the seller, but going by the history of her slow despatch times, I may have to wait another 11 days for it to arrive.
Ebay says the seller has 8 days to resolve the issue - I am not sure I really want to wait that long as that will make it nearly 3 weeks since I bought it and frankly it isn't good enough.
Would I be within my rights to send it back (tracked) and request a refund as item not as described?
And how quickly does one get the refund?

Yes, but the problem with doing that is that the seller may not cover your return postage costs.
How much is a new USB lead? and can you get these from any electronic outlet or are they specific to the Kindle?
If you can pick one up fairly cheaply, this may be a better option than returning it to the seller, and you could then ask them if they will make a partial refund to cover the cost of the new lead.
You can also open a not as described dispute and ask for a partial refund there although the seller doesn't have to agree to it.0 -

I'm assuming the Kindle is charged so you can ascertain it is working at the moment?
Just a thought that if there is no power to it you cant be certain its working until its charged.0 -
It has a little amount of charge, so I can see it is working (phew!), just hasn't got the USB connector.
Popping around to electrical/mobile store in town later to see if he has a cable, if not, I shall order one.
The seller is obviously not very bright - she even got my name wrong on the envelope, argh! Some people shouldn't be left in charge of an Ebay account.31.5/1000 -

Leads aren't expensive online so you'll be good to go soon. May I recommend a bit of software called 'Calibre' to install on your computer? It manages all your eBooks and downloads and is free

If you have a newish mobile phone you should be able to use that charger cable. My last couple of phones have had a USB lead that connects to the plug and the other ends have been the same as the connection on the kindle. Very handy as I can leave one charger at work and use the kindle charger at home.0
