    They said that the system hadn't registered that it had been repaid so it just drained all the funds from my account.

    I'm not too clued up about my legal right, ie. going to a small claims court etc. But i would love to do something about this as they do it to so many people and get away for it. Add on top that this has had a significant impact on my performance at work as i have spent so much time chasing this up.
  • My advice:

    1. Cancel the WONGA direct debit
    2. Call your bank and cancel the card (claim you lost it if they won't just cancel it)

    Sorted... Now they can't take any money from your bank :)

    As for reclaiming bank charges; write them a letter outlining all the bank charges you incurred as a result of the unauthorised payments they took from your bank. Also threaten them with legal action if they don't repay the costs before a set date. If they don't do anything about it by the date you have set (give them a month or two), then look into taking them to a small claims court to get your money back.

    Don't wait a month or two, simply send them a compliant letter outlining your costs and the outstanding money owed. Tell them they have 14 working days to reimburse you all the money. If by then you haven't had the money send them a letter before action giving them 28 days to refund the money. If they then don't refund issue proceedings against them for the full amount plus stuff like loss of earnings and reasonable costs for handling and dealing with this.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Hi Guys,

    Thankyou for your help. Unfortunately, this has still not been sorted after nearly a month. I sent them a statement from my bank a week + ago and they have come back to me and told me that the statement is not sufficient. This is because it only shows the transactions to & from my account. They are now asking me to request a full statement from my bank (which i believe costs money and will take a while) and then send that to them in the post (which will also take time and money). I Asked them why it was not possible for them to check their banking system to see that the funds had not left their account, they said that this was not possible.

    I'm an absolute state once again now. I have bills to come out soon and i thought i was meant to be in the clear, but as they have now not paid me the money they owe i'm going to hit severe problems.

    I'm wondering if i have any legal right now, i feel that it is impossible for me to get my money back. I think they are just exploiting me because of my age.

    If anyone can help, please do!

    As I said you need to send them a letter before action, they are being unreasonable with this, in your letter outline your costs like unpaid bills costs, then add maybe a couple of hundred to cover loss of earnings , send it recorded. You can do little more.

    Okay, so after all of this. One month on, i get an email ...

    Dear Jack,

    Thank you for your email.

    We tried calling you today regarding your Wonga account but unfortunately we weren’t able to get hold of you. On reviewing your email to us we can confirm we issued the refund for £149.10 on 03 April 2012 to the following bank Details;

    Sort Code - 309966
    Account Number - ****3260
    Bank - Lloyds TSB Bank

    In the meantime, if you have any further questions regarding your account, please do not hesitate to contact a customer care advisor on 0871 288 5704. Our office is open Monday to Friday, from 9am to 6pm.

    They have transferred it to the wrong bank account, which no longer exists. I phone Lloyds who informed me that the funds would have gone to a suspence account and released back to them within 5 working days. I still have no reply back from them since emailing them informing them of this. I think it may be best that i now write a letter, what do you reckon?

    Ok, this is what I would do now. Email Wonga and Barclays and TSB copy all documents to all involved. Issue wonga with your intent to claim all charges you have against them as:
    1) they took money that they should not have taken
    2) they had the details of your correct account as they debited it
    3) they refunded to the wrong account (their 2nd mistake)
    4) your hourly rate for sorting this out
    5) create a list of costs (unauthorised fees and your hourly rate ie. you have spent 7 hrs at £8ph plus stress costs all telephone costs +VAT)
    6) copy all to FSA and OFT.

    let the banks fight with Wonga!!

    and watch the money enter your account within 2 hrs.
