    OP, as you were both receiving CB benefits, you were claiming seperately.
    now your CB benefit has run out, you need to claim as a couple.
    it wont be as much money as 2 single claims, but you will still have your DLA.
  • CAB have said thats not the case nannytone... i have to write to them as they have said i should be in the care group not the one i was in especially after just having another esa interview and my DLA put up to higher on both just last month..

    she also said this is taking up all there time atm ESA

    yje CAB are wrong!

    when you are a couple, if one is not entitled to benefit in their own right, then the other can claim them as a depoendant.

    you are talking about whether you should be in the work related group or the support group .... that is an entirely different matter and you need to lodge an appeal if you think the decision is wrong.

    as has been said, the criteria you need to get high rate DLA and to be placed in the ESA support group are totally different.

    at the moment, someone unable to walk at all will get high rate mobility DLA ( soon to be changing), but for ESA, the same person would not get in the support group of they can mobilise using a wheelchair.
