Car write off

My hubbys car was in an accident someone cut him up and he went up the back of them he has a 17 year old volvo the only damage was a headlight sidelight and front grill but age of car and make the ins co wrote it off they have offered a very low amount for the car no way could he replace it with another volvo of the same age, but he wants to buy it back and keep it and there is nothing else wrong with the car, they have said they will cancel his insurance and he has to have vehicle inspections etc and they dont like doing that sort of thing! and there could be a problem with re insuring anyone had a similar problem and how is it sorted please - getting desperate:confused:

    Basically they will write the car off in either and class it as a cat c or cat d write off. This makes the car pretty much worthless when it comes to re-selling.

    This bit im unsure about they will will most likely then pay out for the car but he can then buy the car back at a lesser price off where ever the car has gone to.

    They will probably get away with cancelling the policy as they deem the car to be unsafe and would want one of there independant vehicle people to have a look before continuing your insurance. It will also need a vic check to make sure the car is still the same car if its a cat c write off (not been cut and shut etc).

    I think this will be the case lol (More hassle than its worth imo)

    Try and get them to do a cash in lieu replacement and don't let them declare it a cat D

    thanks for the reply, sorry to be thick but what is a cash in lieu replacement?
    Just had a thought can he cancel the claim?

    Thanks for that they havent stated what cat it is in but thheir is nothing wrong with the car (we have fixed the lights)

    You can go back to the 3rd party's insurance, and say you will not accept their offer, They always make a low offer at first. They may want you to provide proof that the car is worth more (go on to parkers, look at similar cars on autotrader etc and print off cars of a similar standard.)

    If the car is a category C write off, it must have an MOT dated after the date of the accident to go back onto the road. Your insurer will check with the underwriters if this is ok. (to find out what category, ask for the assessment carried out by 3rd party's insurance). You may meed to provide an engineers report that the damage has been repaired.

    As previously said, the car will not have much value to sell on, as the accident will be recorded with DVLA. However, if you can get the car back on the road it will at least give you time to look for another car.

    The vehicle will then need a VOSA (VIC) check which costs £36:00. You need to make an appoinment and drive it to a testing station.

    If the car is written off category D, the accident will not be recorded on the register, it will not affect the MOT or need a VOSA (VIC) check (as far as I know - I'm writing this as someone who's car was written off cat C)

    Sorry - forgot to mention something.

    If you do decide to buy the vehicle back, this should in no way affect the compensation you get for the write off. They are two separate things.

    Also, forgot to mention I paid £100 to buy my vehicle back (p reg polo) it was written off Cat C. All that was wrong with it was a large, deep scratch along the whole side, caused by 3rd party. Don't let them charge you a lot to buy it back.

    MOT cost me £60, VOSA £36.00 so total to put car back on the road around £200. But I also got a full payout for the cost to replace my vehicle.

    Hope this helps in some way.

    can't you change your mind about claiming and tell them that the claim form was for information purposes only?
