car accident and personal injury

Partner had a car accident the other day, basically, she skidded and spun on some oil on the road, no warning signs etc (Must have only just happened) and wrote her car off.

Obviously, she was "at fault" by insurers standards but she has been diagnosed with whiplash and a couple of other injuries and is unable to go to work.

Is she able to claim for this off her own insurance or is it tough luck?

    She cannot claim on her own insurance as effectively she would be claiming against herself - not possible in law. So I'm afraid it's just tough luck.

    Correct, but she can claim for her car.

    Oil? More like Diesel on the road!!

    I found some on the way to work this morning, single lane section of dual carriageway doing 70mph. I noticed a glimmer of the classic oily/watery rainbow effect on the road surface as the sun came through the clouds and realised I was driving with my wheels either side of a 3 mile long Diesel spill, I slowed right down to 30mph as it went off up a slip lane and I was forced to onto it. Even at 30mph it jolted the car to one side as my wheels crossed it.........

    Would love to know how the f**k they managed to dump THAT much diesel!?!?!?

    If I had to hazard a guess, i'd say "horse box/truck", damn things are never maintained, ride around on bald tyre's, belting out black smoke and never seem to have to get an MOT.
