Ex's claim

Yes made my head hurt too! I did my own PPI claim to Egg last year successfully and using Martin's templates it was easy. I do think that this one is a bit (:rotfl:) more complicated as there was a broker involved plus the fact that we are not together and I don't trust him at all....
The problem is also that it's Catch 22 - if I refuse to sign neither of us gets anything, if we do it ourselves and he refuses to sign neither gets anything again.
How much do these companies take (no info re this from ex) and could I start a separate claim in my own right?0 -

What a mess!
Surely, the CMC can't proceed without both signatures?
But can the OP make her own claim without her ex's involvement?
If the ex does sign for another claim the OP instigates does that mean the CMC is entitled to their percentage of any redress?
Makes my head hurt!
I think the claims co cannot proceed without her signing, the same goes for her, she cannot go it alone without ex signing, I would not sign the claims co paperwork and tell her ex they can do it on their own just contact the bank and keep all the redress if they win.0 -

What year were these loans and are they still running or settled?.0 -
They all differ but as much as 30% plus VAT is often reported!Caroline_a wrote: »How much do these companies take (no info re this from ex) and could I start a separate claim in my own right?
I think the problem as you said is that neither you nor your ex can proceed without the other and your ex has already signed a contract with this CMC.
Your ex needs to extricate himself from the CMC, although this could prove very difficult.
Don't be tempted to get any other third parties involved!0 -
I do not think the claims co can proceed without both signing, so there is at present no contract between them both, that is why she has had the paperwork from the claims co.
I would be wary if they do the claim themselves to make it clear to GE or Ocean that they do not take any direction from this claims co or they may end up with a bill from them anyway.0 -

Yes, the ex should seek written confirmation that there is no contract between himself and the CMC if the OP wants to proceed with her own complaint.I would be wary if they do the claim themselves to make it clear to GE or Ocean that they do not take any direction from this claims co or they may end up with a bill from them anyway.0 -
Assuming the policy is in joint names, or the premium was added to a joint loan, I do not think the ambulance chaser can proceed. At best, (from their point of view) they could only claim a percentage of any redress that went to the ex.
This is, of course, provided the OP does not sign any agreement with the ambulance chaser.0 -
So it is not the claims co that want your signature but Ocean and GE?, they will need this to progress the claim, it is the broker that the claim should go to, not the loan company and the broker, do this claims co know what they are doing??????.As it's Ocean Finance the loan was taken out with I have 2 authorities to sign, one for GE Money and the other for Ocean Finance, as one brokered from the other.
One letter to the broker would have commenced this claim and now there will be a fee plus vat, just for posting a letter.0 -
Good Lord, that's bonkers!
Ok, so what would you guys advise me to do next? I've not signed anything, but there obviously is a claim that can be applied for. Unfortunately apart from the details on the paperwork that I've got, I have no other details.... is there a way forward?0
