Hi, as the title states, OH was previously unemployed for a short period of time 2 years ago. He is working in a great job, but they use the previous years tax returns and this is where the problem has occured...
OH was able to do plenty of overtime, so we informed then that it would be quite a bit more, they said to advise nearer the time....; roll on to now and its left us with an overpayment of £2313.00 omg WHAT DO THEY DO???
Can i pay £100 a month, we help our daughter with her rent as her hours have dropped and she isnt entitled to anything. As for paying it in one go, it isnt gonna happen as i dont have it.
Please can someone explain what happens next please

You can dispute the overpayment if you think you were given wrong advice. Request copies of your phone calls. Tell them you want to dispute because you tried to give an updated figure and they said you couldn't (providing this is correct). However, some of the overpayment may still be there.
However, the disregard was £25,000 two years ago. Did your OH income increase by more than £25,000 compared to previous year?
Or did you give a low estimate and then he earned more than the estimate? If it is this you may still have had some overpayment even if they had updated your income.
You might want to get some help from CAB.
As for paying it back, you can arrange a time to pay whatever amount is affordable, if you are still getting tax credits they will just reduce them until it is paid back.

Hi thanks for the reply. The difference between what was prvious years to now is just under 15,000 in income. The payments were stopped just over 2 weeks ago, and then a letter came saying i had been overpayed and this is due now. I could appeal if i thoughht that i should have to pay it back.
We are both working, with only 1 child in education - going onto 6thform in september. It is ful time education. I dont think we will get any benefits as i earn 9k part time and OH is in the region of 21k possibly a bit more.
I will repay if it is a genuine overpayment, just dont think over £100 a month is possible tho!!BSC member 137

Without knowing all of the income figures given during the 11/12 year and your 10/11 figure it is not possible to say whether it is right or not.
I would go to CAB and get them to check it out for you.
Who mentioned £100 a month?
