canceled gym membership. still taking money.

I set up a gym membership last june. cancelled it with the company in august last year. discovered a week ago that they're still taking money from my account. Phoned the gym up and they said "oh you need to cancel it with your bank not us, sorry should have told you that". well they didnt. As i pointed out i dont enjoy giving £30 a month for a service I dont use.

I havent been on the inhouse 'system' for the 7months that they have been taking money. so they know i havent been going.

I have asked for a copy of what i have signed with them emailed to me, just to make sure there was no small print. ( its only a small independant company so i doubt it).

Does any one have any advice on this?

    I'd say wait until you get your contract through.

    Are they saying that you needed to cancel the DD to cancel the contract or that you did cancel the contract but you should have cancelled payment too?

  • They are saying that I have canceled the contract but I needed to cancel the payment as well.

    Do you have it in writing they've accepted your cancellation and the date?

    If not, try and get this information first. Once you have it, write to them informing them they have been collecting payment for a cancelled contract and that they should refund the payments.

    The reason i say to get the information first is as a precaution in case you say you want refunded and they start claiming your contract hasnt been cancelled.

    If they have been collecting the payments by direct debit you can request a refund from your bank via a DD Indemnity claim (under the DD guarantee).

    Not sure how far back they can refund, but you should at least get the last couple.

    I find it difficult to beleive that you signed a contract in June and cancelled it in August. Gym memberships are usually for 12 months at least.
    Read all the terms and conditions before you do anything.

    my local gym dont do 12 month contracts :D Can cancel at any time and they wont take any further payments. Its just basically a 1 month rolling contract.

    Most gyms will allow you to take out minimum 3 month contracts. The trick is to cancel as soon as you sign up. That works. Then there's no chance you ever have to pay for the extra month or two.

    How ironic, this is the exact opposite of most threads about gym memberships!

    Regardless of whether you cancelled the dd they shouldn't have kept taking the money.

    If they won't refund the money then write to your bank explainig (and enclosing evidence of cancellation) and asking for the money back under the dd guarantee.
