    ok thank you thats what i am trying to state if the form was sent out to see my current situation rather than letting a individual fill it in they should approach the doctor surgeon etc as they are treating you and understand your condition putting you back in the same situation after you have won esa by tribunral or the desion maker is wrong,all my medical documentation is dated from dec to this current day due operations for condition etc, doctors surgeons need the respect they deserve,if for example i get asked for a medical and i get 0 points after getting 25% for loss of faculty of my hands for another medical itsquite i am going to appeal and wait another year for a tribunral date its just silly

    all this does is put alot of people back in the system we should be trying to get them out its a waste of money and time a doctor,surgeon is not going to lie about a patients current health situation and like i said deserve respect for their expertise and not people to try and say different am quite sure every body on this forum trusts and confides in their doctors they deserve respect

    I think you are getting confused over what your doctor/consultant has responsibility for and what Medical Services (ATOS) have responsibility for.

    The first treats you from a medical/surgical perspective and the second asseses you from a medical disability perspective.

    The two are totally different.

    Your doctor/consultant is there to treat you and keep you healthy. ATOS are there to assess you in line with the descriptors that would indicate to the DWP that notwithstanding you medical/surgical problems, you could still have some ability to carry out one or more of the recognised work functions - picking up a coin off the floor, being able to sit for a short period of time etc.

    No one is saying that the DWP are not giving your doctor/consultant the respect that they deserve - they do, the same way Medical Services also deserve (but rarely get) respect for what they do.

    It's like a football team. Not everyone is the goalkeeper, there are other postions besides.

    i understand that and respect that but at the end of the day atos and the dwp know your condition and know why you are on esa in the first place the decision maker or a tribuneral has agreed to that, a basic update from your doctor consultant is all that is needed they dont have to put you through all the worry filling forms in etc so many people suffer from worry anxiety and this just puts more pressure on there condition,if it was a new claim with a new condition yes i agree but definally not a on going one,if the system works correctly then i should score

    the correct points to be on esa if a medical is requested as my condition has not changed !!!! which can be proved with all the medical evidence that won my appeal in the first place and more, if i fail the medical then there is some thing seriously wrontg with the system will go back in the appeal process and probably will win waste of time and money !!!!!!!!!!!!!!

    also the examination is not physical how can they state a person is fit for work via questions its not logic they need to get physical tests done on each condition that is claimed made my medical a joke at my triburenal complete shambles !!!!!!!!!!

    atos and the dwp knew your condition.

    With every review you are required to re-state your problems as they may have changed - for the better or for the worst.

    You will have to re -score the points again.

    When you won the Tribunal appeal it was for a limited period of time - a time in the future when you would have to be reviewed again. This can happen every 3 months if the DWP want it to be!

    As I have said, your doctor/consultant do not feature in the decision making other than to bring a perspective of what your health is like. They certainly have not got the qualifications to assess you from a working point of view - that is the job of ATOS.

    Are you actually suggesting that as long as your GP says to the DWP 'that your health condition is just the same' they should continue to award you ESA?

    Cloud cuckoo land if you do believe that!

    There is nothing wrong with the system - they are re-checking you as they should with everyone.

    Some are re-checked every 3 months, others every 3 years and most somewhere in the middle.

    They could ask if you watch Coronation Street. If you do, the computer assumes that you can sit quite comfortably for at least 30 mins without having to get up.

    They could ask if you have a dog. If you say you have, the computer will assume that you take it for a long walk at least once a day and have no problems talking to people you meet along the way. The computer will also assume that you are capable of looking after the dog as you would yourself.

    They could ask if you go shopping. If you say that you do, the computer will assume that you can walk round a large supermarket for maybe an hour mixing with a lot of people.

    When all of the answers have been given the computer will say if you have passed or not. It's a simple as that!

    good morning i understand that but basically what you are saying is a person can lie to the questions then pass, surely when a person passes they are checked with there doctor etc to make sure they have a medical condition which backs there claim up,medical proof must come into it some were ?
