Husband has accepted offer, but I don't want to sell yet?

Hi,
Just after some advice on the selling process please? My husband and I have seperated and our house went on the market 4 weeks ago.
Today, we had a third and final offer from buyers that my husband has accepted with the estate agents, but I am not happy with the price/decision.
What is the process now. If I say no and don't agree to it, will we have to pay the estate agents?
We have signed a listing agreement, but nothing else yet.

It will depend on what your contract says...but normally if the estate agent introduces a proceedable buyer and you are deemed to have accepted the offer then you are likely to be liable for fees. I guess where it gets complicated is whether you both needed to accept the offer, what was agreed when you appointed the estate agent, was it agreed that your husband would deal with them? Is the offer worth so much less than you think the property is worth that it is worth paying the fees for?0

If you jointly instructed the agents then they need the agreement of both of you.
If only he instructed the agents then only he will be liable if the terms are such that they can claim commission on a proceedable offer - he will have to find the money as it is nothing to do with you!
If the house is jointly owned then he can't complete the sale without your signature so it is going nowhere.RICHARD WEBSTER

Is it the price you are unhappy with or that your husband accepted the offer without your input?
4 weeks and an offer is accepted is great going at the current time. Many houses don't even get a viewing in that time and I think I heard this morning that only 1 in 3 houses actually sells at present.
So what is the real issue here - price or emotions?
If you are just annoyed but the price is okay I would let it ride. Think about the benefit it would mean as in you and your husband can get on with severing all financial ties and moving on with your seperate lives rather than having this house standing as an obstacle?
As for the EA, depends very much on what is in the contract but they generally will try for their money whatever.0 -
Divorcees make the worst vendors. I know several who frustrated the sale to get at the other party, and ended up with a lot lower in the end. Personally, I would just want to get rid and move on with my life, rather than engage in a futile battle for a few grand extra.Been away for a while.0

What price has he agreed to, and what price did you want?
It's a difficult market, and you have a buyer who has put THREE offers in, so they obviously want it.
Surely you want to move on with your life? It may not be the price you hoped for, but what's money compared to freedom and starting life again?
I've just gone through the same thing, although my ex had unrealistically high expectations of what it would sell for, so it's been a nightmare. After I told him some home truths, thankfully he eventually saw sense and accepted an offer. Not long 'til completion day, and I will be celebrating in style!!Should've = Should HAVE (not 'of')
