                    Hi all,
I've read some threads about the lovely Parking eye people as i have received a letter from them.
My questions are:
1, How are they wrong to do this? Do they not have the right to do it as i thought i may have been in the wrong.
2, How can they get away with it?
3, What are the normal tell tale phrases to look out for on the letter i have received?

            They are not in the wrong to send you a letter. I could send you a letter.
 They are not in the wrong to send you a letter asking for money. Again, I could send you a letter saying I had fallen on hard times and could you oblige me with £60.
 However, their letter has the same legal validity as mine. It is purely a request, though they do their best to convince you that payment is required rather than that they are just asking if you'd be good enough....
 and their letter will certainly be for a quite outrageous amount completely disproportionate to anything which you may (or may not) have done.
 So, you have no need at all to take any notice.
 How do they get away with it? Clever wording which is designed to convey a different impression to what they actually say. By asking, they are not, unfortunately, breaking any laws.
 However some of the agents they may use to write follow up letters frequently do break the law. And you can sue.
 What they cannot do is to force you to pay though they will do their darndest, with half-truth and lies, to persuade you otherwise.
 What was your heinous crime, anyway? Parking with the shadow of your radio aerial touching a marking line?0

 It says something along the lines of that i was allowed to park for free for 2 hours but i stayed over that period of time (i did) and then failed to pay the appropriate parking tariffs.Not yet a total moneysaving expert...but im trying!!0

            OK, well, if you were busy shopping in a retail park, then I am sure that their masters- the owners of stated car park- won't be unhappy with the situation if it means you spent a bit of extra cash...
 but regardless, what could be claimed, is losses which were suffered as a result of your alleged breach of the terms... let's see now, if the car park is free, how much did they lose? Sounds like queero- need any more clues? Usually represented by a circular or oval symbol? Yes, that's it, zero. They lost nothing because of your misdemeanour. So that is what you REALLY owe them. Not the arbitrary hugely exaggerated amount they are asking for.
 Remember that the only bodies entitled to fine citizens are: Courts, the Police, and the Councils. The list does not therefore include Parking Eye. Though no-one seems to have told them as they just keep on trying. Maybe that's because there are folks mug enough to pay them? Not on MSE there aren't!0

            Strictly speaking, you do owe the car park owner the charge for however long you did park for. We are careful to to condone non-payment. But, by demanding more than this, they overstep the law.
 Personally, I would offer the car park owner the charge in "full and final settlement". And tell them that, if their agent, the PPC, sends any more letters, that you will sue them under te Protection from Harrassment Act 1997.
 If they accept it, OK. If they decide to play rough, you have the moral high ground.
 And, with luck, the threat of being sued (and it's easy to do) should make the owner think twice about using a PPC, and terminate their contract.The acquisition of wealth is no longer the driving force in my life. 0 0

 If yours is Parking Eye then they are suing people and so are some other PPCs.
 You must appeal and with current forum advice, you will win at popla - we win 100% of appeals in 2014.
