Dreams or Section 75

Hi
I hope someone can help! I bought a mattress in March 2008 for £1389.00 from Dreams . It is no longer fit for purpose so I called them today . After 4 calls lasting over 1 hour , they said someone would call me tomorrow to arrange an inspection. I have never been spoken to so rudely in my life and feel this could be a long hard battle . Can I just claim under section 75 as I used a Marks and Spencer credit card and let them sort it out with Dreams as both are jointly liable? I rang Marks who were equally as unhelpful and said they didn't think they would refund me but to pursue it with Dreams first. Am I being fobbed off by Marks and Spencer- surely 4 years for a expensive mattress is not good enough!

    Whats wrong with the mattress ? I think Dreams are acting correctly by arranging an inspection, allow them to do this, then see what their response is. You never know, they might agree with you.

    You're not being fobbed off by anyone.

    It was purchased in March 2008! Why is it not fit for purchase now - probably some fat !!!! person has knackered it!

    Let them inspect it and see what they say.

    I have taken a carpet installer to task before (twice) and on both occasions they made a reasonable offer for compensation after the inspection. One of these occasions was several years after installation.

    So don't assume that you're being fobbed off.

  • I am not saying I have been fobbed off by Dreams - I just found the customer service agents to be rude and I guess I am looking for an easy way out by using Section 75 on my credit card.
    Thanks for your comments - jonesMUFCforever -its "fit for purpose" not "fit for purchase". And just to let you know I am 5ft 2 and weigh 9 stone - so wrong again!

    You still haven't said why it's not fit for purpose. You asked if you were being fobbed off.

    What's an "easy way out" what do you want them to do ? You can't deal with a Section 75 claim if you haven't allowed the retailer to resolve your problem first or your case will just be thrown out.

    Sounds as though you just want a refund or replacement. For a 4 year old mattress, thats not going to happen without an investigation by Dreams. If at all.

    So, whats wrong with it ?
  • You have answered my question - I have to go down the Dreams route first.
    There is dipping , either the springs have gone or the "tempur" part is no longer "bouncing" back .
    I bought a ten year guarentee . I am hopeful Dreams will sort it .

    If you have a 10 year guarantee you shouldn't need to approach your CC issuer. Depends what it covers though ! Have you read the guarantee ?
  • Yes I have but its very vague . It mentions "normal" dipping . I had no reason to believe I would have a problem until I spoke to the customer services which I thought were a bit "off" and then found dozens of forums with other people saying they had problems - but dosen't mean I will , so will go back to thinking that I wont have a problem - and all will be well.

    It also excluded the use for lady of the night business
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
