    Can I please just point out that Atrix has asked for advice on how to go about getting the correct information and how to move forward with their claim not to have their post hijacked by people wanting to go on about entitlement, politics and other unhelpful things.

    So unless you have what the OP needs please don't carry on and don't insult the people who have posted useless info as it is just as useless.

  • i have asked for a statement of reasons i was told to send in a letter with a statement for reconsidderation and to ask for the statement via writing.

    ive contacted my benefits advisor, who should contact me before long.

    i just need to put a letter together now.
  • my ben advisor cant see me untill 30th at three. wich is only just inside the two week period.

    i havent recieved the statement of reasons yet.

    The two week period is the extension you get to appeal so instead of four weeks you will get six weeks. You will possibly get the SOR tomorrow or saturday if you are lucky make sure you sit down and read through it thoroughly and note any incorrect information with the page number, section/activity number this will help your advisor no end when dealing with your appeal.

    well theres not much i'm affraid.

    i tried to complain to atos for not returning my evidence to me, i have called several times with no joy at getting through. i have also e-mailed a complaint as to wich i have had no reply.

    i requested a statement of reason wich never turned up after 2 and a half weeks, had to call again, and now finally have it.

    if i had my evidence i would be able to disprove most of what is said about me, but hey ho they seems to have not sent it back to me.

    my GP is going to write me a letter of support.

    my friends are also going to a statement for me to give an idea of how my life is day to day as they see it.

    wish me luck i'm going to need it.

    @OP, any advice from benefit adviser yesterday?
    I remember reading in another thread that it's standard practice to put former IB claimants on contribution based ESA wrag automatically, so you shouldn't take it personally.
    The 2 weeks is an extension to the month you get automatically from the date of decision, this is either an extra 2 weeks from when you ask for a statement of reasons, or from when you receive the SOR if it arrives after two weeks, keep the envelope for proof, it should be franked and dated. You should check the direct.gov website for more info.
    You will probably have to get the evidence again, don't rely on ATOS, but you can start an appeal process without any evidence/ support letters, just write saying you are appealing and will send more info later, send recorded delivery if poss.

    @ fogartyblue, you seem to be of the opinion that anyone on incapacity benefit merely had to ask for it and was given it, this is the way the media portrays it sometimes aswell. The truth is, just as now, there were forms to fill, evidence needed and medicals to attend, it's even the same company doing the medicals. The practices haven't changed, but the rules have.
    This has caught out a lot of people, which is why so many have been found fit to work after years on IB. You shouldn't listen to the medias statistics but look them up for yourself, you will see many people have these decisions overturned on appeal and many make fresh claims, then get awarded ESA.

    It's also my opinion no fraudster will ever be caught out by a form or a "medical" from ATOS, it takes a specific mindset and skill base to be a fraudster, they're just too well prepared. The only way to catch these people is active surveillance.

    I just post what I see as being relevant, the options available and tell it as it is without flowers and chocs. I don't believe in sympathising with anybody, that will get nowhere. Give them the hard facts and they then know where they stand.

    Yes I am blunt and a lot don't like it. But at the end of the day kissing and cuddling won't make any difference to the end result.

    What a lot of nonsense. Since when did sympathising with someone, get us nowhere. Okay we're not saying it will change the end result, but actually it might because if people feel others are sympathetic, it might just give them the strength they need to pursue their appeal.

    Don't you see that one of the main reasons people come and ask questions on this particular section of the board is to get just that. They want to feel supported and that they're not the only ones in this situation. You say you give hard facts, but actually so many of your posts are negative and brutal opinion,not facts at all.

    The facts you give do nothing but startle,overwhelm and scare people when all they need to know is the procedure to follow. Yes you're entitled to your opinion, but does it always have to be so negative all the time? I feel you think there's something big and bold about you saying it how it is, well done you, but that hasn't exactly got you anywhere either has it. So I think the majority of us will still follow the line of sympathy and support and I have a feeling we'll get a lot further in helping than you, for all your hard facts.
