Credit card providere won't release org contract paper work

i wrote to Captial One using the MMT template asking for the org paper work for a credit card we had for 10 years. The account was closed in Jan and then looked into the whole ppi thing. They have quoted they're under no obligation to provide documentation, section 78 of the consumer credit act 1974 does not apply.
I can write the whole letter if any one wants.
I'm smelling a rat but what do i do now.
