Samsung TV - Need advice

Hi everyone - Happy Easter!

I bought my TV from Comet around 3 and half years ago, i even took out a 2 year extended warranty! so 3 years cover in total.

Typically my TV developed a fault after the 3 years - There is patch oif clouding in the center and all down the right hand side - most noticable on green when watch the football.

I contacted Samsung via it's awful online/email method and after several exchanges i had this fresponce:

I am sorry to hear you are still awaiting a resolution to the problem with your TV.

Unfortunately since the product's warranty and your extended warranty have both expired, Samsung will be unable to book the unit in for any free of charge inspection or repair, as there are no known manufacturing faults of this nature with your model. Please find below your nearest Samsung service location you can contact in regards to arranging inspection or repair of the unit:

**Company Name & Address.

If the engineer can determine that there was a problem with this particular unit at time of manufacture, please forward the service centre's report outlining as such to us, so we may arrange free of charge repairs.

Please note that the Sales of Goods Act applies only to the retailer, and not the manufacturer. Further information on Samsung's warranty policies can be found here:

I rang the locally company and they want a non refunable £50 charge, which if there is a fault will go to the cost of the repairs!

I don't have £50 and from what i have researched the clouding is a Manufacturing fault and it's within the 6 years period - So what do i do now?

    You will need written proof that the problem is due to an inherrent fault, then you will need to present Comet with this and tell them that you don't consider 3 1/2 years a suitable life for a TV.

    It's unlikely, but you may get away with printing out information about the fault showing that it's fairly common, but Comet would be within their rights to ask you to provide a written report that's specific to your TV (from a TV engineer or someone similar), or they may do this themselves (and charge you).
    If the report is in your favour then Comet should repay you the cost of the report.

    If they agree that the fault was inherrent, Comet may offer to repair the TV, give you a replacement (unlikely to happen), or refund you. Any refund can have a deduction from the price that you paid to cover the 3 1/2 years that you've had good use of the TV.
    If for example they think that a TV should last 5 years, then they may only offer 30% of the purchase price as 3 1/2 years is 70% of the 5 years estimated life.

    I guess proof is something that is essential here, but from what i can make out if it is the manufactures fault ill still be £50 down!

    Your contract is with Comet, not Samsung. The retailer is the only one who can offer any sort of remedy here but as above the onus is now on you to prove that the fault is inherent to manufacture. If you pay for an inspection and this succesfully proves an inherent fault then you are entitled to have this cost refunded by the seller.
