Should we be paid for travel time when in works van?

Hello everbody, Some advice please if you can?
We work for a building company they pay a set rate of .25p per mile over 40 miles per day when using your own car. EG= 100 mile round trip 100miles minus 40miles = 60miles x.25= £15.00.
Now they have got a works van so we travel to a central point were we get in the van, it is not the company base it is were the site manager crosses our path to work.
So we drive 30miles to the van it takes 45min in the morninig then the same in the afternoon.so paid .25x20=£5.00
Then we spend an other 45min in the van till we get to the site at 8am then we start getting paid then we finish at 5pm pay stops then. So we travel in the van again for 45min to our cars then drive home.
My question is should we be paid when in the works van or not? we have been told if we do not go in the van we will not get mileage allowence on that part of the journey.

a - it depends on your contract
b - you are getting paid mileage to get to the van where they could say you have to make your own way there [financially] so could easily remove that mileage if they wanted to.
c - if you don't go in the van do you get paid from when you leave home?If you haven't got it - please don't flaunt it. TIA.0 -
A= Our contract says nothing about travel.
b= I agree.
c= If we dont go in the van because it is not going to that site that day we get paid mileage over 40miles per day but if the van is going to that site and we do not go in it we do not get paid mileage.0 -
Would you be disciplined if you stuck your backside out of the company van window ?Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0

Drive to your employers yard for starting time and let them get you to the job, sense should prevail at this point.Don’t be a can’t, be a can.0

You are already subsidising the companies poor business plan by paying most of its travel costs out of the wages they pay, at 25p a mile, you would be loosing at least 50p every mile if you do the correct sums, also make sure your insurance is not sdp if the police stop you on way to work your car will be going in the pound.
The problem is jobs are hard to find and employers can demand you pay them a good slice of your wages back to help them make more profit and insist you have a car available at your expense to be used at their beckon and call.
The solution would be to all stick together, drive to the yard and ask the van to collect you every day and take you to site, that it has proper seats with belts (YOU will be fined if not) and you are paid from leaving base to arriving back in base at night.
That is the correct solution, anything else and you are subsidising the firm and loosing wages.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
The solution would be to all stick together, drive to the yard and ask the van to collect you every day We have asked the site manager to do this but refused because he would have to get up earlier so we could be on site for 8am even though we start out from home which is 10min from the works base at 6.30am and get back at 6.30pm and get paid for 8.5hrs0

A very good question, which goes to the core of the issue. Seriously.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -

Since when did you have to be at the workplace doing somthing to get disaplined?0 -
Are you disputing wear and tear car usage payments (per mile used) or are you argueing wages?
The example you lay out is that they expect you to travel up to 40 miles to work. Anything above they pay you 25p - this seems to be a wear and tear payment and not to do with wages.
If you aren't using your own car then you can't be expecting a wear and tear payment for usage.
If this is about wages its a different matter - In that case (and depending on your contract) I believe they should be paying you for the time you are picked up from and dropped off from. However I'd expect this to be an hourly wage rather than a per mile rate.0 -
Evilm,
The mileage they give us is not a problem everybody has to travel to work and .25p a mile over 40 mile is fair. Its when we are in the works van is the issue we spend 1.5 hrs a day in the van unpaid.
Should we be paid or not?0
