Advice regarding sick pay

I'm having to take time off work. I've been attacked and I work in Customer Services, so going to work with a black eye and a broken nose isn't really an option.

My employer says I have to take 3 days sick unpaid, then get a sick note for any remaining days off I take. Is this correct?

If you only get SSP then yes the first 3 days are unpaid, but you can self certificate for the first 7 days, so you will only need a sick note after that time. SSP is £70.05 per week, which is tough to live on!! Is there no way they could find you something to do that is not with the customers until your face has healed?

  • I'm sorry, excuse my ignorance  I don't know what SSP is, does my employer not pay me for being off at my usual weekly rate? I'm going back to the hospital tomorrow so I'll ask for a sick note then, as that'll be my 3 days. I only work 3 days a week anyway, so this is effectively a full week for me. I can't do anything behind the scenes as there is no other jobs for me to do, there is only ever 1 cashier on shift, as there is no need for more. The rest of the work is carried out by employer, which I'm not trained to do.

  • Depends what sick pay it says your entitled to in your contract.

Employer doesn't have to pay you sick pay if it isn't in your contract.

SSP is Statutory Sick Pay which is paid by the Government.

Sorry to hear about your attack. Are you okay? I can't offer advice about what is or isn't paid as all employers are different. Just wanted to say I hope you feel better soon.

    Take care.

Were you attacked at work? This would change the situation considerably!
  • Hi,
You may be able to claim from the criminal injury board as you were attacted

    Evans,

My girlfriend has recently spent 3 weeks off due to an operation, the hospital do NOT issue sick notes any more as most people can self-certificate for 3, 5 or even 7 days. She went to her doctors and got a Medical/Doctors certificate to send to HR of her company for the additional days. From this the company can claim from the government, and so pay you.

If you were attacked do you have a Police Incident Number to send to your company. Sounds like your company are pants -to put it nicely. Do they pay when someone has a cold?

Chase that Criminal Injury Board, may get a leaflet from the Police Station. Sometimes they even call you direct, I had this when we were burgled.

    Good luck,
    John

the hospital do issue sick notes but I think it may only be if you're an inpatient
If my typing is pants or I seem partcuarly blunt, please excuse me, it physically hurts to type. :wall: If I seem a bit random and don't make a lot of sense, it may have something to do with the voice recognition software that I'm using!
