gym membership cancellation

Hi All,
I have a 12 month gym membership.
Their shower is boiling hot and it has been three month that they are keep saying that is has been looked into which it has not.
the thermostat is apparantly faulty.
anyway, i sent an email to their email address on their website and the dd company and mentioned that u are in breach of your contrtact by not providing a usable facility thus cancelling my contract,
i sent this email 3 times and no acknowledgment. in the last email i mentioned that if i do not get any replies, i assume that you have received the email and have no objection
can they leaglly do anything?
can they impact my credit rating? i do not think so as they do not have any finance agreement with me. for instance mobile phone can impact the credit references as credit card loan and other but things such as home phone , gym membership should not be able to

Depends whether your gym membership has been paid upfront by a third company who are then receiving monthly payments from you or whether you're just paying monthly. You should also have a look at what facilities are included in your contract and which ones arent - are the showers listed as available facilities?
You need to have a look through the paperwork you were given to find out exactly what type of contract you're in and also what the requirements are to cancel.
I would say to send a letter of cancellation recorded delivery and keep a copy of the letter - along with the receipt for recorded delivery - for your own records just in case.
In your cancellation letter, it would be wise to note time and dates of the complaints you made to them so that if it ever goes any further, you can show you gave them adequate time to solve the problem and they failed to do so.You keep using that word. I wonder if there are any health and safety rules with regards to temperatures and what temperature the showers are operating at.........
May be worth looking in to it. If there is, take a thermometer and get a reading for the water temperature - this combined with the fact you've given them ample opportunity to rectify it is likely to be very strong evidence in court to justify rescinding the contract.
With regards to your credit file, bear in mind the above post - but in my experience, most gyms don't report to credit agencies.0 -
Do gyms even bother chasing? I think most of them know they are on to a sticky wicket with lots of their contracts so flog them cheap onto DCAs to do the legwork.Thinking critically since 1996....0

Having a usable shower is a fairly reasonable thing to expect as part of the contract - and failure to provide it would be grounds to cancel or rescind in my opinion. But your response should have been to write a letter and request that they put it right within a reasonable time eg 14 or 21 days, otherwise you might cancel. And only then if the do not fix it, to cancel.Hi, we’ve had to remove your signature.
