Hi, any help or advice would be great please.
Our next door neighbours have a flying freehold over our property, one of their bedrooms is over our kitchen. We now have the opportunity to buy this room and we really want to. My question is what do we need to do? Who do I contact? Is there building regs issues, any help as I said would be amazing please.

Do you have a mortgage on your current property, you will need to take advice from your lender if you do.
You need to negotiate a price between yourselves and your neighbour, how do you plan to pay for this, cash, mortgage? if mortgage you will need to pay for a survey by your lender to agree a value.
When you have agreed a price contact a solicitor, do you have to pay the neighbours costs too.
does the neighbour have a mortgage if so their lender will need to agree?
Lots of questions, I would first agree a value and go from there!0 -
Hi. We have a mortgage but they don't. We have agreed a price and are paying this from our savings rather than extending our mortgage. We are paying for the fees on both sides.
Do we need planning permission to do anything?
Thanks very much for your reply.0 -
I am not an expert so I would suggest you take the advice of a legal professional but I don't think you need PP. You do need to instruct your mortgage company and you will need to get a lawyer to change the deeds of both houses.
You mortgage company may want to send a surveyor to agree how the room is going to be taken into your property and how the current entrance is blocked.
I would talk with your mortgage company first.
Oh you may need some building regs!0 -
Surveyor def needed to investigate access and ensuring the neighbour's house is fire-walled away from yours.0

Don't forget you'll need to re-route their and your electrics (and plumbing if there's any heating). Also, you'll need to know what else is under their floor - could be all sorts.
And what about the roof? Or is it flats?0 -
Why pay their fees?0
