Capital One PPI help

Hello all,

I've had a Capital One account since 2000. I shamefully realised recently that I've been paying over £10 PPI a month and couldn't understand why. As per the advice on this site I wrote to them asking for the original T&C's as I didn't have the original paperwork. They wrote back stating they "have sent a reconstituted copy of my original agreement and included, although not required under S78, a scanned copy of the signed signature page of your original agreement. Under the CCA there is no requirement to provide you with a photocopy of the original signed agreement". They quoted a case by Judge Waksman QC in Carey v HSBC (2009) 3417 (QB).
It was so long ago I cannot remember. And because I can't find the original I can't prove if I ticked the PPI box or not. If I did tick it, I can't remember why, as my job has always provided me with the benefits I need should anything happen to me.
I have cancelled the PPI payments but as far as they are concerned I ticked that box and that's the end of it.
Is that the end of it? Should I pursue this any further or leave it alone? The letter they sent pretty much scared me!

    Put a claim in with the reasons you have, sick pay, life insurance Etc, state that you had no need for this insurance as you had cover in place elsewhere and would not agree to pay for something that would only cover you for 12 months for sickness that you had from your employer for free.
