Car tax and HRM

Hi,

I have just been awarded HRM and so I can get my car tax disk for free. As I didn't know I would be getting this I have just got a new 6 month tax disk.

How do I go about getting it changed and reimbursed etc?

    You get a form from the post office and send it back. They will only pay you hole months back so you will get 5 months worth back. They will send you a cheque.

    Firstly, you need to be aware that by using your HRM to have the *free tax disc* you will be changing the taxation class of your vehicle. Bear this in mind should you wish to change the vehicle within the next few months.

    Now you have the award of HRM, you need to obtain a DLA 404. Ring the helpline on your award notice & hey send you out a form to obtain this. It's the DLA 404 you take to the post office to obtain the tax disc.

    This takes time, so don't rush off to surrender the disc you've just bought.

    Once you have a new tax disc obtained using the 404 THEN surrender the one you have for a refund of the remaining months.

    Bear in mind that if you do this, it also means that the vehicle can only be used by, or for the benefit of, a disabled person.

    So if your partner uses it as a daily driver and/or to commute to work. Changing it to the disabled class means they wont be able to do this any more.

    Thanks for the help. The car is only ever used for me, hubby cycles to work as he's a keep fit geek. He even does it in the rain and cold! Tbh we couldn't afford to drive all the time anyway.

    They have enclosed to car tax certificate with the award so that's not a problem either.

    I already have a blue badge but I dont think I will go for a mobility car unless mine becomes unreliable.

    Thats incorrect. Where does it say this in the DVLA rules?
    I think you are getting the car tax disc mixed up with the Motability Operations lease scheme
  • Lum has the correct legal understanding, Denny Crane is wrong.

    VED exemption is a 'grey area' if you look at the DRAH / 35th / Ch5 / S2 you will see that :

    HRMDLA / War Pensioner exempts VED [road tax] for one car only. However .. the vehicle is only exempt whilst it is being used "solely by or for the purposes of the disabled person".

    It is the case that neither the DWP nor the DfT clearly define exactly what this means [case law might - but I've never looked it up] However whilst using an exempt car for purposes totally unconnected with the disabled person is clearly technically illegal, its one of those areas that is cost-ineffective to police and so unless there is a specific reported event or an obvious and flagrant abuse of the VED exception its unlikely ever to be noticed.

    I do however expect this 'turning a blind eye' / 'liberal interpretation' to change in the coming several years as the 2012 Blue Badge central database / instant verification checks will give LA's, the Police and any enforcing authority more power to tackle fraudulent use of the VED along with the capacity to cancel BB's and / or / to confiscate them on the spot.

    NOTE1:

    Yes the current rules cover the disabled person not necessarily having to be in the car, instead, it could be used to do their shopping or running errands specifically for the DLA404 / WPA0442 / MHS330 / holder etc.

    What's the betting that when this new scheme comes into place, people who are genuinely running errands end up getting harassed by police and vilified by the daily mail as cheats and fraudsters?

    They will sadly, and its always the genuine innocents that are caught up in this. Its precisely those whose intention it was to 'find a loophole' in most means tested & need tested benefits to 'bend the rules' to their advantage that brought the disabled as a class of people into this situation in the first place.

    Unfortunately as has been demonstrated in this forum the last few days there are many disabled people who are more than prepared to 'misinterpret' the rules to their advantage with their well rehearsed gerrymandered view of rules and law bringing the disabled into even more disrepute. As you say Lum the RedTops will have a field day.

    The bottom line on this is still the same as a post I made on this precise subject and the impending legislative changes a couple of years ago. The genuine user who sticks to the rules has nothing to fear from the authorities .. .. but unfortunately everything to fear from the anti-disabled chav's, and their RedTop friends.
