. Can I still pay the council anyway?

Yes ,they cannot refuse your payment, however any valid bailiffs fees are still liable and can be enforced through the liability order as any payments made first go towards fees and then to towards the actual debt.
If the bailiff hasnot been into your house then the only fees they can charge are £24.50 for a first visit and £18 for a second visit. They cannot charge for subsequent visits.

I need more help on this matter.

The bailiff came round yesterday and posted a Form 7 with my cars reg on. They want to take it. What should I do. Help.

I'm in the process of frying to move it, but my mechanic has the keys and the cars engine doesn't work.

No point in trying to move the car now the bailiff has levied it once goods are levied they belong to the bailiff

Can you tell us what figures the bailiff has put on the notice of seizure (form7) as in outstanding council tax visit fees levy fees etc.

What is the approximate value of the car as it stands now?

Ask your mechanic if he will give a breakdown of repairs needed and costs for repair(in writing) also ask him what he thinks the car i sworth if sold as it stands

Once you get the answers to the above (from the mechanic)

You may be able to challenge the levy if the value of the car won’t cover all bailiff fees, to include visit fees, levy fee, attendance to remove fee, removal fee storage fees, auction fees, and a portion of the debt

I know so once goods are levied they are in the custody of the law in other words the bailiff now legally owns the goods they don’t need your consent

The goods can now be removed and sold at auction if the debt including fees are not paid

in a word yes-- the car now belongs to the crown and if you sell it or remove it with the intent of hiding it you will be arrested under the Torts (Interference with Goods) Act 1977, also if you intentionally damage the goods you would be arrested. If you sell the goods you will be commiting fraud and the person you sell them to would be arrested for handling stolen goods

Hey again guys. I sent off the letter in post #18 from RAS. However they did not reply with the correct information, all I received was two letters:

One which was a template letter telling me how much I owe again.
And another which was typed and signed from the bailiff which basically said how much I owed again. There was no mention of all the information I asked for or how she had come to that figure.

    What should I do now?

    Hi again Nothadoth

Put a complaint in about their failure to provide a breakdown of the costs - do so in writing, copy in the council as well as CIVEA (bailiff trade association - full details online, just google them).

Make it clear to the bailiff that you will negotiate to pay back the debt and any VALID fees, but nothing beyond that. It's all about standing your ground.
