    Reading that tells me that you've decided the car is not for you, and that you made a mistake buying it, so you're hoping the dealer will have it back.

    I have to tell you that I've had brand new cars that have been more trouble than yours and none of them were replaced as not up to merchantable quality.

    They should notify you at the beginning of the call that its being recorded. A formal complain can be made if they told you this during or after the call.

    That's wrong.

    You are allowed to record calls and you don't have to tell people as long as the recordings are not passed on to third parties. So, if the call is used purely as proof of who said what to who then they have done nothing wrong.

    You can request the recording under the terms data protection act.

    Call centres who play the "Calls may be recorded....." do not do so because of any legal issue. They do it as a courtesy and to let people know that if they are abusive, racist or lie during a call it might come back and bite them. People tend to be a lot less abusive if they know they are being recorded.
