Landlord states he requires months notice from me to leave property?

Well no the ll has to give at least 2 months notice and certainly cant not terminate before the 6 months.
It actually means that the LL can *serve* notice at any time (to end after the 6 months) but that the tenant can only serve notice after 6 months. And therefore has to stay for 7 months since he has to give 1 months notice.
This clause is not legal though so you are still fine to leave on the day the AST terminates.0 -
As has already been said you do not need to give notice if you leave at the end of the fixed term. In vacating and handing over the keys on the last day of the fixed term you have left in time. You do NOT have to pay any more rent. If you had stayed an extra day it would have been different.
Your contract doesn't say you have to give notice, but if it did that would be an unfair term and not enforceable.

Good advice on that site and in line with many responses when this topic arises. As a rule, I always prefer '.gov.uk' web URLs over forums though these ('.gov.uk' web URLs) are sometimes contradictory!

Hi, don't want to open a new tread as my question is about notice to leave. he have moved to our current house on the 17th November 2007 and now due to constant problems with our landlord ( work on replacing tiles in bathroom's been going for 8 months now, no interest whatsoever to fix problems he has promised when we moved in ) we want to move out. I have starting looking for a place and found a nice house just not sure how to give the notice. Our initial contract finished in November 2008 and we haven't signed a new one. Do i have to wait for the 17th to come and then give my notice or just give it now and count a month from now

You can hand it in now but it must give a clear month's notice from 17th April, i.e. to finish on 16th May. Assuming it was a standard 12mth AST which has now turned periodic.0

Yes, it was 12 month assured tenancy. Thank you for the advise i thought we have to wait to move out till may. Hope we don't loose the house we found. It is almost impossible to find someone who will wait for you to give a month's notice and with a small child i cannot just give my notice and look for a place.0
