eBay dispute (Delivery refund) - which option?

I put a thread up earlier in the week about seller not refunding the delivery charge for me sending item back [for which I am entitled to as business seller and Buy Now item].

Further to this I have put a dispute in with eBay and trying to get the seller to action and accept to no avail. On the resolution area there is three options:

* I haven't received it yet.
* I received an item that does not match the seller's description.
* I want to return an item and get a refund.

The seller does not use eBay refunds process so could not put it via there so used the second option which is as best as I could.

The seller is saying he will not refund the delivery charge as he is not obliged too and that (I quote) "" Please continue as you wish, claim what is legally yours within the law, I wriggle out of nothing & understand the law & how you are using it. I will not help/assist/train you in this claim or how to complete it, I have no legal obligation to do so. Escalate your complaint, but I will not allow it via this channel of complaint. I will not continue to respond to this channel of dispute."

I am waiting for the time period to lapse so I can raise to eBay to resolve but am I using the correct channel and reason seeing as there is nothing else available?

    You should've chosen option 3 "* I want to return an item and get a refund."
    then input your return tracking number, update with Ebay and they will refund you.

    I tried that but when clicking "Next" it says
    This seller does not use the eBay returns process. To return the item you need to contact the seller directly.
    If you want to return this item because you believe it is not as described and you haven't been able to work things out with the seller, contact us to open a case.
    Your purchase may be covered by eBay Buyer Protection.


    So won't let me

    As the seller is in clear breach of the DSRs you might be better off phoning ebay or using livechat. I've always found them very helpful.

    Thanks, I used live chat and they will investigate and reply within 48 hours.

    Just to update, eBay refunded my original postage fees when I escalated the case to them and this was done within 5 minutes of the case being with them.

    I like to get one over the sellers when I know I am in the right
