    Definitely worth sending a CCA request, Remember not to sign them and send the appropriate payment (either someone elses cheque or a P.O.) If nothing else it will give you a breathing space.
    Indeed look at that other site, it gives a lot of good advice

    I already sent a cheque, one of mine. Why do you advise not to send my own cheque?

    They could forge your signature on a credit agreement.

    However the company could send you a reconstituted credit agreement they do not have to provide the original.

    In that case it would be obvious as 1/2 of them were opened before I got married.

    Well so I heard, they scan and lift the signature on a letter/cheque.
    Well that would be great if they tried to send them with your married name/wrong address etc etc.

    When you get them, have a look at the all about debt site....Niddy is somewhat of an expert at what is enforceable and what isn't

    Stephensons probably aren't the best to link to be fair :rotfl:

    But they cannot forge it they can however actually utilise elements taken from other 'sources' in order to satisfy a s.78 request which as you correctly pointed out, was part of the Cary judgment (by the most bizarre judge that walks the planet) however lets not forget, whilst Carey did allow for a recon it did not take away the creditors obligation to provide a statement of fact as to the origin and if they are using a recon then there is a high chance we'll win as 99.9% of recons are bad.

    Then we start working on the terms etc etc etc
