Leadership Martial Arts Problem Contract

Hello all,

I normally just peruse this forum but have decided to register after encountering a problem.


Back in january I joined leadership martial arts. I told them I had crohns and diabetes but they said it would cause a problem. However after just a few weeks training it start to cause me a problem so was unable to train. I decided to leave and cancelled my direct debit.

However a few days ago I get a letter from nest management stating I have to give them a months notice. At the time I was never told this. Looking at the document that was sent its not covered by the FSA and no credit or loan was involved.

Is there anything I can do? I've tried 2 days on the trot and they never return my calls.

    Do you have (or have you asked them for) a copy of the signed contract you entered into with them?

    Does this contract indeed state that you need to give them 30 days notice?

    Did you inform them at any point prior to being contacted by nest that you were cancelling? Or did you just cancel your payment method ( please be aware that cancelling payment method is not the same as cancelling the contract itself).

    Thanks for your reply. I just cancelled my direct debit. The letter I received stated that I may have inadvertently missed the requirement to give 30 days notice. The thing is I was told it was just a direct debit mandate. Nothing was said about having to give a months notice. I feel particularly upset as I only had 6 lessons before becoming I'll and now have the risk of facing surgery simply because some of there training has caused an existing condition to be exacerbated.

  • Cancelling the direct debit does not cancel a contract, merely stops you paying, likely reneging on the contract you have signed.

    Dig out your contract (or ask the company for a copy) and if it says 30 days notice you have no choice but to pay up or face further consequences that may include court action against you (but unlikely, given the small amount of money).

    I mostly agree - particulalrly about cancelling the DD not being the same as withdrawing from the contract.

    But, as I see it, if Jasperman said he has conditions X and Y and the Martial Arts outfit say "it won't be a problem", then it is worth a punt to argue that he took the contract on the strength their advice, which has turned out to be wrong and should therefore be able to cancel without notice.

    However, he needs to cancel and state why in writing - and the date of cancelling should be no earlier than the date he informs them in writing.
