......Just out of curiosity, is it an offence for him not to have reported it? I thought that was only the case when there were injuries?

yep, damage or injuries you need to stop and give your details to anyone reasonably requiring them.

If you don't then you need to report to police asap and in any event within 24 (48?) hours.

If injuries are involved than as well as the above you must produce your insurance, either at the scene or to the police.

Right the first time 24 hours.

@scotsbob - see first post - no witnesses which is why I don't think we'll get anywhere.

Only mum's word that her car was fine when it was parked, and the tyre shop guys who saw the green paint on the back corner of his car and knew he had just reversed into the street. Looks dodgy but still just circumstantial evidence.

For a claim you don't need firm proof, it's a civil matter so it's the balance of probabilities - i.e. which story sounds more likely?

There may not be witnesses to the collision itself but given what the owner of the tyre place saw (i.e. damage to the other car, with paint scuffs matching the colour of your mums' car, just after it had been seen reversing into the area where your mum's car was parked.)

It might not be enough to get a criminal conviction but a civil court is, IMO, likely to believe that it was the car responsible for the damage. more to the point, his insurers probably would too.

Let the police sort it initially then see if he gets 6 points for failing to stop and give his details.

Claiming from his insurance will be so much easier then, And the points make make him think twice next time.

Thanks again all. I told mum about the £4 to get his insurer's details from AskMID but apparently when she spoke to the police they said that they would give her the details, so she's waiting on them.

    Saves £4 at least. :)

Oh yes.... A few years ago I had a minor bump. A car was turning left in front of me and stopped suddenly halfway into the turning. I clipped their back corner with my front corner. I was barely moving but dented my front corner. They had an old car - one of those with a huge tough bumper and I couldn't see any damage to theirs at all. I stopped and got out but I'm not sure they had even noticed as they just drove off. I got their number plate and mum said I should go to the police station and explain what had happened, just in case (which I did). Never heard anything further.

I'd forgotten about that - mum telling me to report it was obviously the right thing to do. :)

    Quick update:

Mum had a call from the police today. Think they finally got round to looking at the case as they are going to visit the tyre fitters to see what they remember/say and are also serving the other driver with a 28 day notice to produce his details/paperwork. Apparently they'll follow up with her after that.

Mum's still hanging on to get his insurance details from the police to save paying the £4 (she has more patience than me).

She's enjoying the fact that the guy probably forgot about the whole thing and will now get something from the police.

    Another update:

Police are going round to take mum's statement tomorrow night! Apparently they've written to the driver requesting some details and he has ignored them. That takes some nerve!
