    If the house is 50% yours legally then no he can't make these calls without your consent. He can't rent it without your consent, the mortgage company can't make changes to the agreement without your consent, and if the loan is a joint loan then they cant refuse you access to discuss it!

    Mini, if you want my advice, sit down with your Solicitor and discuss getting a Court Order for Sale. If you are on your 3rd solicitor already I dread to think how much you have spent with no result. If you have no access to the loan or mortgage but the house is still 50% yours, and your partner is being obstructive not allowing you access to the finances, it seems like you've got no more options?

    I am assuming you're not paying anything towards the mortgage. But if the tenants failed to make rental payments, you are jointly liable with your ex to cover it, so you need to sort it out!

    I would let go of the fact that he is pocketing rent as I'm not sure there's anything you can do about it. If you want to get his attention you need to try to force the sale, then all the details regarding the unauthorised tenancy etc will come out in the wash.
