Joint/Mortgage with ex.. a bit complicated

Hi all,
I am in a very tricky position regarding joint mortgage and abusive ex, I will try and keep it brief. We are currently in the process of divorce, it has taken one year to get to nisi stage, I fear there is much longer to go anyway he is renting out former marital home to tenants and he has come to an agreement with the mortgage co that the tenants pay the interest straight to the building society and he pockets the rest. There is a secured loan with first plus {that is another grey area as they won,t communicate with me as they want his permission which he won,t give!} I an unable to answer the security questions relating to the mortgage so they won,t speak to me either:mad: I have approached the tenants for a copy of the rental agreement but they won,t give me a copy because it is between them and him and not me. I guess my question is are the building society allowed to do this without my permission? Thanks in anticipation Mini xxx

I've never heard anything like this before. If you're named on the mortgage how can he have done all this without your permission?
Have you been to see a solicitor? Also what do you mean you can't answer the security questions? Do you mean he has set security questions relevant to him, which you don't know the answers? Surely you can set up your own security questions?
Sorry I can't offer any advice but I'm stunned that this has happened to you and worried too as I am currently going through a divorce and always assumed as the house is in both our names we can't do anything without each other's permission.0 -
Have you tried going into a branch of your mortgage bank with some proof of ID. I can't see how they could refuse to speak to you about it then.Do you not know that a man is not dead while his name is still spoken?

Hi Thanks for the replies, trouble is I am on my third solicitor already, I think I am on very new ground here so no one knows actually what to do. The situation is complicated further but I don,t want to introduce any more confusion that is unnecessary.
I can answer most of the security questions until it comes to how is the mortgage paid, specifically what bank account? that one I can,t answer as I know the tenants pay the interest but they won,t give me that information.
My current solicitor has advised that I am best removed from the mortgage as a course of action and therefore he, the ex will take on the full liability of the mortgage and secured loan, however this does not address the fact that he has been pocketing the rent for three years and the fact that he has a tenancy agreement without my name on it that the building society has basically endorsed without question, no one seems to be able to tell me whether this is legal - even my solicitor. The children and I don,t seem to figure in the equation. Everyone I speak to says he can,t do that, he can,t do that but fact is he has.
I was just hoping someone with knowledge of mortgages could point me in the right direction, to say if it is legal or not, many thanks for looking and replying Mini xxxDeep doubts, deep wisdom, small doubts, little wisdom..............0 -
Sounds to me like he has done something illegal i.e. forged your signature or stolen your identity and passed someone else off as you. Is this too far fetched do you think? It is possible, it's amazing what lengths exes will go to! I think an appointment with the mortgage provider is what is needed to get to the bottom of it.

Thanks Penny, no it is not too far fetched at all, I know I have been strung up like a kipper, he knows a lot of people and comes across like prince charming, very plausible, but underneath I suspect a severe personality disorder, trouble is he knows people and can cover his tracks, leaving all the onus on me to prove, but because he is clever and gets institutions/family/colleagues to collude with him {lord knows how but he does} he then gets away with it.
