Hi all wondering if anyone can answer the questions i have about the DRO. We have been advised to go the DRO route after contacting national debtline. One of the questions they ask are along the lines of have you ever claimed bankruptcy in the last 6 yrs because if so then you wont qualify for a DRO so i did claim bankruptcy 4 yrs ago i filed in march 2008 and got the discharge certificate in october 2008. This bankruptcy was done in america because thats where i resided for 8 yrs with my hubby who is american(i m british) we have been back in this country for just over 3 yrs now. Does this bankruptcy count? because it was outside the UK, we did ask the advisor but he wasnt at all sure
Secondly we are paying for a computer at £27 a month for 2 yrs we are only 9 months into the plan do we return the computer or do they seek to take the computer, also same with sofas we are 9 months into an 18 month credit agreement with harveys, do they get the sofas back?
any help or info at this time would be great thanks

You can't get another DRO for six years but there is nothing to stop you applying for a DRO a few years after being discharged from bankruptcy (obviously you can't have one while undischarged).
You just have to answer the questions: ARE YOU CURRENTLY IN AN INSOLVENCY PROCEDURE? (No)
and
HAVE YOU BEEN IN AN INSOLVENCY PROCEDURE BEFORE? (Yes)
If yes, the only following question is 'Date started'. I guess the DRO Unit then looks into it, and asks for more details if it wants to.
Regarding the computer/sofa, it depends on the agreement. If it says that the goods can be reclaimed, then that might happen. Never known it though.0 -
