Question on housing benefit and don't live at property

Hello, I live in Brent and currently I own the propert with my brother. He moved out many years ago do I pay the mortgage. My other brother last his job 1.5 years ago, I applied to get hb and they said no because I live here. It's put me in alot of problems as I couldn't afford to pay all my bills so had to go via payplan. But I'm now getting married in August, I want to live with my husband but am worried about this mortgage because I aant afford to keep it. Does anyone know if I would be entitled to receive hb for this house once I move out. So people who don't own the house will live here.

    Why don't you just sell the property you can't afford ?

    The people who live in the house you vacate and will be renting to would be the ones qualifying for housing benefit if on a low income as housing benefit is meant to pick up rent shortfall . I'm not sure why you think you'd qualify for housing benefit on a home you don't live in or pay rent on ??????

    If you OWN the house you'd be recieving rent from your tenents-so why would you need housing benefit anyway ?????

    Am I missing something here ?

    Oh yeh I don't want hb, but would I mum and bro get it. Mum is on pension credits and bro is lookin for a job. He use to pay 880 a month for rent but then he lost his job.

    I think you mean as it's a right to buy you can't sell it for another 5 years.

    If the "other people" living there once you leave are only your Mum and brother and you have drawn up a tenency agreement for them to pay you rent -in SOME circumstances housing benefit would be payable although under right to buy are you allowed to let it out ?

    If however there is no tenency agreement -then there is no housing benefit payable as housing benefit is meant only to pay/part pay rent . So if the terms of your right to buy allow you to rent out the property then it might be wiser to formalise the rental situation with your family when you move out. I don't know if there would be any complications with the claim as they would be paying rent to a family member however-there might be.

    Sorry not right to buy, I took a 10 year product and got 5 years left. If I sell I will have to pay £15000

    have you asked your lender for consent to let or find out if you need to change to a BTL mortgage. Does your co-owner brother pay part of the mortgage? Have you asked him if he can buy you out?

    So does your mum currently live there now (and if so, does she pay you rent) or does she intend to move there? Is your brother planning to move back there?

    Why doesn't your new husband move in and share the bills?

    You cannot rent it without your mortgage companies permission. Once you rent it you become a landlord even to your own family and will have to have LL insurance, annual landlord gas safety checks, comply with fire regs if it is a building of multiple occupancy....

    Not quite sure why you think you'd be entitled for housing benefit when you live in a house you own.

    If your brother owns the property with you, even if he doesn't pay anything towards the mortgage, then he can't claim HB.
    If your Mum lives with your brother in a house that he owns, then she can't claim HB as she would be living with a close relative.
    The only option would be that you sell the property or rent it out if you can't afford to live there.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

    Situation is mum will be staying here alone, she has no interest in the property. I read somewhere if the owner of the house is not residing in here my mum would get housing benefit. I could quite easily rent this house and mum could find a one bed flat that she can rent and the council would give Hb. Had that confirmed by them.
