phones 4 u premier plan insurance

Hi All
I took out a contract blackberry bold 9780 phone insurance with phones 4 u, using there premier plan insurance company.
The contract started on the 5th March 2011 so did the insurance
In December 2011 the phone developed a fault which was later discovered to be water damage i paid the £10 excess and £6 postage. The phone was returned and i was told at the time it was a refurbished handset,but it arrived with a broken mains lead. I phoned to report this and was told to go on amazon and but a new mains lead for £2.99 which i did . A month later the battery became faulty and would not hold a charge. They sent me another battery. and now another month later the phone has now stopped working completely.
I rang again last week and was told that it was my old hand set that was repaired which i took as the truth but was still not happy that another fault had developed. upon further investigation i have now realised that the phone infact is not my original phone as 1) The old ones buttons were broken on the top of the phone, 2) my old phone had a slight crack on the screen, 3) my old phones battery cover would not stay on, and finally the imei number was diiferent.
I phoned again today and again asked the question is this handset a recon or my old one they again said my old one repaired, when i told them this was not true and the diffferences they said its prob got a new mother board i then explained that this would explain the imei number but not the other issues.
The phone has developed a fault were as to i cannot use it and the isurance company wanted us to pay a £50 excess and £6 postage to sort it out. I told them i wasnt happy with paying this amount as i fell that the first claim hasn`t been dealt with properly but they say its not within there 28 days warranty but as a good will gesture they will halve it.
I feel that i have been lied to about my phone being either the old one or recondition can i refuse to pay the excess and under what conditions can i refuse

Old phone repaired sounds a bit of a moot point if it had a new motherboard, new back, new buttons, new screen... It's like 'Triggers Broom' - a broom he'd had for 30 yrs, with 15 new handles and 20 new heads. Basically by that time there is little of 'your' phone left, if any.0
