Is it illegal if person X uses person A's wireless connection to connect to the interent,

if person A had a laptop and went to person Z 's house to show him some photos. Mr X living next door has an open network. The laptop is set to conect to any available network & while the photo's are being viewed it usees mr X's network to download a mass of updates from M$ . Would M$ be liable?
