Credit file marking...Help!!

    Isn't there some logic to this?

    1) The OP received money that wasn't his(hers).

    2) OP spent it.

    3) So became overdrawn when the money was taken back . No overdraft had been agreed.

    True repayments may have been agreed in order to bring the account back into the agreed terms. But isn't it the fact of the over limit status that is being recorded?

    Just spoke to experian, they've said as I was in an arrangement plan, unless I miss a payment within the agree arrangement plan credit file should read (AP) so just waiting to get through to Santander, 5 mins and counting. :-((

    I know your really not going to want to hear this.... but i have to share.

    I had nearly the same issue as you a tad different, i had a premier 21 account, with A&L and they charged me 50p a day for the overdraft. was so expensive i had this is 2007/2008 before it went to santander. anyways when the test case with the banks came my account got put on " supsended " was left like this for 1 year. then i got a letter from santander saying " call us we want the money back " after the FSA lost the test case.

    I phoned them up and was put on £30 a month over 2 years to repay the £500. they started reporting it as 3,3,3,3,3 on my credit file ( 3 months late ) i kicked up a fuss noone listened to me, they did eveything.

    In the end i ended up going to the ombudsman and i won, it took 2 years ( decision was made last week ) but i won it and they removed all the arrears information. its great however it took 2 years!!

    i have a horrible feeling its going to be an ombudsman jobby!

    They ombudsman basicly said that there was no arrangement and the formal terms and condition had been changed. and santander shouldn't have put this 3,3,3 or AP markers on my file

    However something intresting is the complaint team shouldn't make you go to the ombudsman if something like this has previously been raised with them... IE my case. so maybe you could tell them something like that?

    I would've just given back what plainly and clearly wasn't mine....no wonder you're having issues.

    Thanks for the ever so unhelpful advice forum troll, if I would have had it, I certainly would of done, and I wouldn't be asking for advice.

    In other news, thanks all for the helpful advice spoke to Santander who said they're going to update it as x6 0's :) (we will see if this happenns.....;0)

    Ok, think nothing of it person who spends money that doesn't belong to them :)

    If you hadn't spent it, how come you had to pay it back in dribs and drabs....I'd know if somebody had put 600 in my account and I'd want to know why?

    If someone put £600 in my bank account I would quietly stash it away for a rainy day or until they ask for it back. I can provide sort code & account number if anyone wants to be so kind :)

    Seems like a good result for the OP if Santander reset all the credit file markers.

    They've said they will, have to send a letter to their data disputes team in Milton keys tomorrow. Will update on my success.
