PPI on credit card - HELP please

Hi.. I have a claim with Yorkshire Bank.. some months ago they accepted and upheld my comlaint that PPI was mis-sold on my credit card, I asked how far back they went and they said 7 years I advised I had statements going back to 1995 so they asked me to send samples. I had to chase them up and they confirmed they had rec'd but advised they had uncovered something which would have changed the original decision but advised they would as goodwill gesture pay me what they had offered, I had to chase them to find out what they had uncovered & they advised they had found the original application and I had not ticked a box to say I didnt want PPI?? they have sent me a copy and the box is blank, I didnt tick appears I had to opt out if I didnt want it... I dont know what to do take what they have offered (£800) or take complaint to the FOS would really appreciate any advice any of you can give thanks

    You could get back in touch and restate the reasons you were mis sold this PPI and let them know that you were not aware at the time that you had to tick a box to decline the PPI and that you will be asking advice from the FOS.

    Hello,

    Don't think the FOS are very keen on the 'opting out' method of being sold PPI. Have a read of the factsheet below and you can always ring the FOS and explain where you are with your complaint and get their take on things.

    Thanks for your responses.. i plan on acting on the advice you have both given... the copy of the application they sent me does not state costs or anything like that it does however suggest that the applicant refer to a leaflet (?) for more info... they have not included the leaflet so going to call them Monday and ask for a copy I'm also going to be really honest with them and tell them I'm still not happy and considering going to FOS.. I guess I'm a bit of a wuss really I'm worried if I don't accept their offer I'll end up with nothing.. maybe that's what they want me to do take the money on offer now and go away??

    That might be a reason you would give for NOT ticking the box;that it was impossible to make an informed decision without referring to a separate leaflet which you don't have. I wouldn't ask for this leaflet, it would only list what the PPI covered and the costs and it's likely long since out-of-print.
    You need to complain on the basis that you had to opt out of the insurance.

    I wouldn't bother asking for a copy of the leaflet either. I also wouldn't call Yorkshire Bank about this, I would put it in writing. If you do have to take this to the FOS it's best to have things in writing. You will also need a 'final response' in writing from Yorkshire Bank as well.

    Do call the FOS though and explain your situation - it doesn't mean you've handed it over to them to deal with, they can just give you advice and then you can decide what to do. I would do that before contacting Yorkshire Bank again.

    Emphasise the fact that you had to opt out of the Insurance.
