Suing landlord for return of deposit

Yet another landlord wanting the deposit for betterment thread...

Having told us when leaving (September 06) that the house was fine, the garden was a bit overgrown (brambles from BEHIND our fence and next door's tree) and he'd probably need to get someone in to clean the living room carpet (fair enough), Landlord decided that not only did he not want to give us any of our deposit back but would ask us for another £280:mad: !!! He was charging an hourly rate of £20 per hour for re-doing cleaning that we did before we left :mad: :mad:

Went through the steps of asking him for a breakdown and negotiating before Christmas to no avail. We told him (in a letter) before Christmas we'd be suing if we didn't get the deposit back.

Anyway - we now have the money to issue! I have followed the advice on Eager Learner's thread (thanks, btw :A ) and have Court papers sitting next to me here to be filed tomorrow when I'm off work...

    I take it there was no initial or final check out inventory which was agreed upon and signed.

    No, no agreed and signed inventory.

    He told us in a letter he'd taken video before and after we moved in - we checked our moving in inventory and the video was taken THREE YEARS earlier.

    We actually moved out on the Friday but didn't hand the keys back until the Monday so we had time to clean etc. He went in on the Sunday (before we'd finished and without permission) and I think he's basing things on then - we hadn't been to the tip etc or finished cleaning.

    He also used to have a go at us if he ever "nipped round" because of the amounts of shoes in our hall - we're two shoe loving women - AND IT'S NOT YOUR HOUSE!!!!

    So, there was a moving in inventory. Did you sign and agree with that one?
    Or was there an independent witness present and who confirmed the date of the video?

    Why would the LL take a video after you moved in or did you mean on final check out?
