Again refunding and postage where does seller stand?????

Hi have just sold a swim jacket/float jacket on Ebay Buy it now which in the details says it is " Brand new fixed buoyancy aid swim jacket "
they emailed me saying they thought you could take the floats out and would like to send it back,they obviously haven't read the listing properly ,so i emailed them to say i would refund the cost minus P&P if they returned it still BNWT at their own expense.
Have i been fair? where do i stand? i will still end up out of pocket.:mad:

It depends if you are a private seller or a business seller, if you are a private seller then you can pretty much muck your buyer about as much as you like until eBay or PayPal get involved, however if you are a business seller you must give them a full refund + P&P as long as the item arrives un broken, it doesn't matter about packaging, and if you are a business seller then you should really follow the distance selling regulations and have the item picked up from their premises.0

Im a private seller on ebay, I sold a new item which didn't have tags. The buyer received it and gave me feedback to say I was a recommended seller. 10 days later I received an email from her saying that she had sold the item on to someone else and the person who bought it off her wanted a refund because she said it was not new. My buyer had said that she had not used it so therefore she was going to open a case and request a refund from me. Her logic being, if she had to give a refund then I would have to. Emails went back and forth and the case has not been resolved by us as Im refusing to give her a refund. After escalation ebay have decided that the buyer should send the item back and receive a refund from me. I cannot believe how unfair this is. My papal account has been suspended as is now in negative balance waiting for me to give the refund. After arguing my case with ebay in the Philippines Im no further forward and don't know what I should do. The item was over £100 and I no longer have the money. advice very much welcome0 -

This is a thread started up by someone else about a different situation.
OP....If your buyer were to open a case with Ebay/Paypal then they would tell them to return the item for a full refund.
So just tell them to return the item and then you will refund in full. Anything less could get you black marks and bad feedback.0 -
It just seems so wrong i am a private seller and if i refund will be down around a fiver because they didn't read the listing :mad:
