Helping other victims of the CEO

Following a successful appeal to the Independent Adjudicators can I do anything that will help people that have had tickets issued for the same offence at the same location to get thier money refunded. I am so insensed by the attitude of the Local Parking Services that I want to hit them where it hurts.

    Good plan. But you will need to say where this happened and the reason why the ticket was unjustified so that people can be helped?

    Assuming you are referring to a council adjudication then the local press may be of help.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    When I received a PCN for an alleged bus lane infringement back in December 2007 I discovered (with the help of Pepipoo) that the wording on the PCN was not compliant with the legislation. Barnet Council refused to back down and it went to PATAS who ruled in my favour. The local paper were very interested in my story and published a nice article. This story also made it to the Evening Standard.

    As Peter said, the local press may lap up this sort of story.

    No PATAS, I know that I can probably get coverage in the local paper but is there a mecanism for getting a refund when they have already paid the penalty charge? We are advised not to pay the PCN if we intend appealing as this is taken as a guilty plea. But if the offence is subsequently thrown out by PATAS surely all those that have previously received a PCN for the same aledged offence at the same location should be able to reclaim their penalty charge payments. I regulaly walk past the location where I got my PCN and if I see a vehicle with a ticket I tuck an information leaflet letting them know both the grounds and how to appeal. I can be really nasty when I am crossed, especialy by these jobs worths.

    We don't know the reason why the Adjudicator allowed your appeal. If the Council was held to have erred in law, then they should refund any drivers who were duped by invalid tickets.

    Otherwise, your case does not create a precedent, for example, if the adjudicator found that there was an error in facts in your case rather than law.

    If we are to help I think you need to put us in the picture.

    Most regular posters (not me) have been to adjudication and won dozens of times. Join the club and help the newbies when they post, once you have read a lot of threads and know a bit about the regulations. You could search pepipoo for the place where you got your ticket and I bet it's been covered lots of times already. But you'd be very welcome to join in - just don't bump an old thread or post advice unless you are certain about it.

    Point of Law a dropped kerb in the London area that no longer has a purpose as defined in The Traffic Management Act 2004 page 55 section 86 (a) (i,ii,iii). This should also apply to others that have previously received a PCN for the same offence 27, at the same position. I would like to help them get their money back.

    Yes. And not only at the same place as yours, but at any other place- anywhere- where the dropped kerb no longer serves any purpose.
