Phone up customer services, find out when you are due an upgrade, if your contract is due to end in the next 3 mnths, you should be put through to to the upgrade dept, explain, you need a new handset (don't say why) and preferably you would like a [STRIKE]cheaper [/STRIKE] more efficent tarrif, I did this got a brand new phone, and a £10 per month 150 min/150 text package! Not too bad at all!
If you are nowhere near the upgrade date, phone and ask for the manufacturers address as the phone will still be covered by the 12 mnth manufacturers warranty, then get it sent to them, if it's pooped-ma-hooped
you might be lucky and get a replacement!

be carefull if he was on a contract phone, they might hold you to it even though you don't have a phone and bill you for the line rental etc till the end of this current 12mth period, i've heard that happen a LOT

The phone may well be dead but the sim (& contract) will have survived. Pick up the cheapest unlocked or Voda PAYG phone & pop the sparkling clean sim in that.

If the sim proves defective, your mobile provider will replace it for a small fee (eg 3 just re-issued mine for £5).
