UPDATE *****************

I GOT A LETTER TODAY 17TH APRIL. its from the parliamentary business unit telling me that jacks dla would be reinstated at the same rate as before for 2 years.

then says that the decision maker has decided that high rate care was right afterall and they have sent a payment.

i am over the moon but wondering why this letting came from this unit, was it because i had spoken to my mp about it.

we got our decision today and my son has been turned down yet again due to the school report.

letter just says needs no care and decision is from report asked for.

i have rung for an explanation and apparently they cant give me one as its the specialist childrens team has made it so we have to wait for a call back that can take 5 days. i am fuming, all because we mentioned adhd on his forms then suddenly he has no care needs.

funny that the seizures and the feeding tube hasnt gone away, funny they didnt know about the tube or the seizures or the joint problems or the physio yet they knew about his adhd.

useless !!!!!!!s. time to get appealling but still have to wait another 3 months.

    sorry to read this.
    as you know many children receive DLA with ADHD so i'm sure it's not that - (we never had a problem with either of our sons, and they never contacted schools either)
    school sound particularly unhelpful to be honest - they could have written extensively on the care your son needs for his seizure & feeds

    put the appeal in - and don't give up :)

    oh no thats rubbish i havent got much hope now if school get involved i hope it sorts itself out and you get a right decision xxx

    Do i appeal or just ask them to look at it again. anywhere i can go fro help and advice for appealing as im unsure what to do.

    Ask for a statement of reasons so you know what they turned you down on and so you can actually see if they have got things wrong. Then go to appeal as far as I understand it asking for the SOR will give you an extra 2 weeks to appeal instead of just 4 weeks. I am sure that one of the other mo savvy posters will be on later to give better advice.

    do you have a SENCO?
    can you talk to them?
    will your GP help? haven't they contact your GP about the feeding tube etc?
    SO hope your appeal goes through qucikly
    just in case you need to know:

    If you go to appeal a different decision maker will re-examine the paperwork anyway (which can take up to 12 weeks at the moment) so I don't see any point in wasting time with a reconsideration first.

    The ' ' Parliamentary Business Unit ' ' is nothing to do with Parliamentary Business .. .. its merely a business address of the DWP from which a DM of a more senior grade to the original has reviewed the original decision.

    Whether or not you choose to pursue a further appeal as others have said ask, for a GL24 and a SOR. The SOR should reveal the departments thinking and decision criteria, get a copy and go from there.

    When they ask .... .. and they will if you intend a further appeal, make sure you have it recorded at their end that your decision will depend on the contents of the SOR, and the time for the appeal application wil depend on how quickly they can get the SOR to you.
