we got 'stung' late in teh day on a TPO also. Only found out about it 3 days before exchange. On the plus side the only reason we found out was that there was planning permission in place to fell th etree in question as it was dying but it was set to expire in a couple of months after we moved in. We just got it removed straightaway to save having to reapplpy.

The link above is the more interesting point, all the trees are under a blanket order near us, our houses all back onto a rail line and it looks like the order was to prevent certain work on the rail line. However there is no public access and on the opposite side of the line is a factory so technically the not visible/accessible to the public line seems fairly valid. We're also meant to be planting a replacement at some point as part of the planning permission terms.
