Next door neighbours willow tree hanging over our garden

Hi next door neighbours have a couple of trees and they are right next to the fence, the branches hang over into our garden and onto the conservatory. The problem i have is im fed up of the amount of leaves that come into our garden every year. I have been sweeping and raking up the leaves.

Yesterday i spent ages raking up the little green things that have fallen off the branches (not sure what these are called). Only to find this morning there are loads more on the grass and the patio area. There are still a lot on the tree.

I have a 18 month old little boy that likes to play in the garden, i don't want to have to rake the garden every time he wants to play out. But feel i have no choice as the grass is covered in these green things.

My house is private rented and so is next doors. Im not sure whether to contact my landlord and see if he will get the branches cut back.

Also they have made the conservatory roof all green.

    By law your neighbour owns the tree as it is on his land, however the branches iverhanging your land can be trimmed back as far as you like (as long as you dont go into your neighbours land). Assumming the tree is not protected by TPO or in a Conservation Area you do not require permission to do this but it may be helpful to inform your neighbour (and landowner) of your problems and intentions

    And the neighbour might even offer to trim the tree, as that keeps them happy it is done properly, or at least according to their wishes. Whether you want to allow them access to your property is another issue, since branches could land on the conservatory. My neighbour has trimmed her hedges from my land for years apparently (I am the new owner), and I told her I was fine about her shrubs overhanging. Just reach a mutual agreement, avoid argument!

    I sympathise with you; we too have a willow tree hanging over behind us. As much as I love nature this tree is the bane of mine and her nextdoor neighbour's lives, it sheds something all year round, whether leaves, little green leaves, white fluffy stuff and during the winter it sheds its small branches and twigs. We have both spoken to them and they have agreed to do something about it but so far nothing - we just cut back on our side as much as we can but the tree must be 40ft+ its not easy! I can't offer any advice other than speak to them, but you do have my sympathy.

    As both of these properties are rented, check your tenancy agreement. I have seen some that state the tenant is responsible for maintaining the garden and others that say the landlord is and bits in between like only LL can touch anything over 6' etc.

    As it hangs over the conservatory you have the small posibility of damage to it, so I'd contact your landlord first, he may rather pay a pro to do it. If not then ask next door to ask their landlord to do it. Or your LL may ask directly to next door LL as he has the right to cut down branches but must offer them back.

    If you cut down branches on your side and damage the conservatory, then you're letting yourself in for as whole load of new problems!

    Try to get one of the owners to do it first, if not do make sure you have your LL permission first before you cut anything due to the possibility of damaging the conservatory whilst doing it.
