Even better, ask them to fax over a copy of all the quotes they received and see if they can provide more than one......if not.....then it is likely (if it ever went that far) they would lose in court as the damages they are claiming, have not been mitigated.
And that is on the basis of them contracting the work out. If it was their own garage who was doing the work....courts would probably look on that less favourably as they should be able to do the work cheaper (at cost price rather than another company adding on a profit).
Thanks so much for advice! I will mention this in my appeal letter.0 -
Got a quote yesterday from my local garage (after showing the picture of the damage and invoice from zipcar) for £150 so to charge £532 is absolutely ridiculous.0

Hi there,
Hope you are getting somewhere with this...
In your original post you said you called them and the operator told you that everything is okay and that you did the right thing and most importantly that you would not be charged. That really IS the most important line in the whole situation.
You can request that the call is pulled and that a supervisor listens to the call. You can also request to listen to the tape or view a transcript of the call. If the operator stated you are not held responsible then you are well within your right to request an immediate waiver of said fee, an apology and if it were me a free years membership/driving credits. The operator has responded as if they are Zipcar and you cannot be held responsible for somebody else's errors.
I have had similar problems with o2 where a rep has told me I am not liable for something and a bill turns up! I got them to listen to the call and they came running back with their tail between their legs.
Good luck!

I have received a decision from zipcar:
The Appeals Board has decided to revoke the damage charge on this occasion given your good membership history with Streetcar and Zipcar as a goodwill gesture.
Firstly all praise belongs to God!
Secondly thanks to everyone on the forum with their advice. From the start of the email I thought I was going to be liable. However the threat of court , informing my peers at uni and my own quote have saved the day!
Thanks once again to everyone!0
