If her car is all sorted, all the more reason to feel confident about sending in a claim for your repairs to her insurer, stating you hold her responsible for the damage caused.
Had they thought you had any liability at all, then they would have come after you!
(Though they won't pay for repairs if that's uneconomic, and would go down the write off route)
I'll give it some thought and may come back to seek more advice from the more knowledgeable on this forum. Knowing my luck though I'll just come off worst if I tried.0 -
You can't claim on her insurance, only she can do that.
You have a claim against HER, which she is free to refer to her insurance company or not as she chooses.
I don't think the classification of the road has any relevance. She has damaged your property, you are entitled to sue her for the cost of putting it back into the condition it was in before she damaged it.This is a system account and does not represent a real person. No.
You can (and many do) get onto the third party insurer direct to deal with a claom where their insured is to blame.
MAny insurers have "innocent third party" claim deoartments who are happy to deal direct with third parties!0
