Is the point of MISS-SELLING being overlooked. The underwriter of the claim would not be aware that the policy they were covering had been miss-sold,and would therefore cover a geniuine claim. That does not absolve the SELLER from acting improperly. Many posts for miss-selling quote the criterior for the miss-sell i.e. conditional on obtaining the product and predominently frontloaded, undue pressure from seller, not fit for purpose at time of sale etc; etc; etc; Martins view says the situation when a claim has been made is 'unclear' not necessarily not valid. Regards and best wishes for your claim, mercbends.

Well, as the first post already points out, the Bank have rejected one complaint and only paid out partially on the other; so you're a little late with your "best wishes".

As you say, there is nothing to stop someone making a mis-selling complaint when they have made a claim, but the only thing "unclear" is precisely what redress the Lender should award if upheld.
