Seller did not make us aware of Major Works, what to do?

    I was all ready to exchange this week got everything sorted until i saw the Section 20 Notice,,

    I am really quite upset that they were not going to say anything not even the sellers solicitors who should by law disclose everything.

    Ah well, im just worried at how many other people who don't understand there leaseholders pack.... or not been advised about any problems with their property.

    I hope that the amount we have to pay is not extortionate...

    So the works are not confirmed yet then if they are DUE this year or 2013?

    You're blaming the estate agent but if they are not told anything then they can't tell you can they!

    Hi thanks for your comment, but you haven't been reading my comments.

    And in most cases the estate agents i have been dealing have not been very helpful at all, their knowledge on properties was very disappointing.

    I think you got a bit too over sensitive.... I was upset that the SELLER who clearly would have known should have disclosed this information..

    You have to consider whether the price you're paying reflects those major works, or if they hoped to find a buyer who wouldn't spot it.

    It's up to the buyer to find these things out, either the way you have, or by asking the question directly at an early stage.

    Well not necessarily, because the seller has had the chance to disclose all this information.
    He quite clearly denied that there was any major works planned.
    Which is a signed document by him.

    There is absolutely nothing you can do about that now.

    The fact is that you now know about the works, and you have the opportunity to either pull out, renegotiate the price, or proceed regardless.

    Either way, the fact that the seller did not disclose something when they should have done does not amount to an actionable breach of contract, as until exchange, there is no contract. Sorry to be harsh, but you need to put this behind you and move on, and decide what you wish to do about buying the house (or not).

    He didnt want to put you off buying his property, but its good for have found out now rather than after exchange , like other posters have said the choice is yours now, either you carry on with buying it or pull out now, or offer him a ridiculous lower price after you have found out how much these major works will cost, perhaps it need under pinning....?in that case id run a mile or 2............Find out what the "major" bit is......

    if it's a leasehold flat , are you sure you'll have to pay anything? If it's been managed well like the one I own(ed), then any major works are planned for and paid from the management charge. Any unplanned work is paid for with the contingency fund.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
