HBOS Credit Card

Hi All,

I'll try to keep this brief but I guess I'm hoping someone can confirm I'm doing things the right way.

Long story short things haven't been great lately financially, have a decent income but debt repayment is taking a large portion of my monthly income, that and living alone for now in a 2-bedroom flat isn't helping.

So I've been paying closer attention to my statements and I noticed that my credit card with HBOS has 'repayment cover' charges dating back to 2006! Upon further research I've discovered that I've been paying for PPI since then without my knowledge!!

After hearing about PPI a lot from this and other websites I decided to not tell HBOS about this discovery and make the claim through the steps discussed on this website (good idea?).

Anyway - I requested a copy of my agreement and a SAR as covered by data protection. I've yet to receive my SAR but I received my CCA (sort of).

Basically HBOS "are unable to provide me with a copy of my agreement at this time" ..Translation, they don't have it anymore?

Anyway I guess this will help my case as I applied for this card in-branch and I remember the member of staff being rather pushy on PPI to the point that I had to threaten to leave in order to continue with the application - I explained that I had no intention to really use the card much as it was mostly for online/electrical purchases and to build my credit rating.

...That was before uni, so fast-forward to today, balance is rather big and I have calculated about £500 of PPI (I think) built up over the years.

At the moment I've filled out the FOS checklist and am about to send this in. Is this a wise move? or should I really wait for the SAR? Obviously having more information at my disposal would be great but at this point I can't see it going any other way, maybe I'm being too optimistic but it is my money that they should never have had. I'm just pretty anxious to get some extra money coming in - that and it would be sent to my parents address (where my accts are still registered) so it would take longer to get to me.

Any suggestions, pointers for HBOS in particular etc?

    Hi there...I wouldn't tell them what you said here...as in, you knew the PPI was there and yet you still continued to use the card. That it is more of a choice, even if circumstances dictated that you needed to use the card more heavily. Also, you can't use the 'didn't know about it' argument if you can recall so vividly being asked if you wanted it.

    Sorry, just read this again and am somewhat confused...you said you didn't know you had PPI but when you talk about the bit where you applied for the card you don't say what the outcome was. I took the line that you gave in and let PPI be added. Was this so? If not, do you think it was added by the salesperson maybe?

    The problem is that you don't actually need this in order to complain. All you need are the account/credit card numbers. It matters little that they are "unable to provide"

    Since you already know you had/have the card and you have obviously decided your reasons for mis-sell, what are you waiting for?

    I was very clear I didn't want it, threatened to leave if it wasn't added. HBOS rep backed down but my theory is it was added anyway - the type of PPI HBOS "sold" me was calculated based on the balance and as I didn't really use my card the first few months I didn't get charged, only after checking my statements a fortnight ago did I notice.

    I can't think of any other situation in which it could be added as I most certainly didn't call up to have it added later.
