Sky Contract

Hi guys.

I am in a pickle here and would be greatful if any one can help me out.

Below is the letter i wrote to sky. I only pasted the relevant parts.

To whom it may concern:

To Sky, I would like to cancel my SKY subscription. Reason being, I got SKY on the 3 Months offer and this is the second month in. I was told you need one months notice for cancellation.

I rang up to cancel my Sky but they did not let me and said that I was on a 12 months contract, however when I rang up to get Sky I did no longer have a working SKY Digital set-top-box, therefore I enquired and was told that the offer to get Sky Digital half price for 3 months using the “LOST 1” promotion code would cost £7.50 instead of the regular £15.

As I explained to the customer service representative about not having a working set-top-box, she told me that I could get the Sky Digital set-top-box free but would have to pay the normal price of £15 for the package, and that it would only be a 3 months contract and not the stranded 12 months.

I therefore went a head with this agreement but instead of having the basic £15 package I went for the £18 package, but when I phoned to cancel as mention previously Sky’s customer support service said that I am in a 12 months contract and not a 3 months contract as it was stated over the telephone.

I had been informed to write to you to cancel my Sky account as they can not do so over the telephone.

So would you please be able to resolve this matter as this is frustrating. As I was misrepresented to what the actual contract I was getting into was, which would therefore be illegal under the Misrepresentation Act 1967.

I would hope this is resolved and would not like to take this to Court.

I would also like to provide some evidence to my claim regarding the 3 months contract. I have a relative who lives on number 51 R******* Street, Derby, who also got Sky on a 3 months contract and cancel last week. His name is M***** A*****. Another relative had also signed to Sky using this 3 months contract and his name is P***** A**** of C**** Road, Derby (his door number eludes me).

As you can see i was told of a 3 months contrct but not when i wanted to cancell.

I therfore wrang and was told to explain why and what i wanted in wrighting and sent the above letter, in a few days i recived a reply from Sky saying no can do and that it is a 3 months contract, and if i left before i would have to compansate sky.

I wrote back to them saying that they just sent me a standered cut and past reply and did not even tackle the issues mentioned in the letter.

a week went past and i did not recive a reply so i wrote another letter, i still did not get a reply so i sent a letter by 1st class,recorded signed for delivry.

Its now been a week and i still have not recived a reply.

I have canceled my Sky Direct Debit Today as i have no intentions on staying on any longer. I told Sky in the last letter that i went into the 3 months offer as it was stated then because it was a good offer and i could afford it.

I also told them that i am disabled and do not work therfore i have a limited amount of income for my self and calculated that i can afford this offer with my benifits for 3 months sacraficing other needs.

So guys what should i do if sky want to force me into a 12 months contract? can i get out as i was told it was 3 months and i no longer can offord it, hence why i went for the 3 months.

any advice would be apriciated
